How Does the District Attorney Handle Murder Cases?

This is an interesting question because if you or a loved one is charged with California Penal Code 187 PC murder, you want to know exactly how you're going to be dealt with.

Having worked for the district attorney's office in the early 1990s, I can attest that murder cases are treated with the utmost seriousness in Los Angeles County.

In fact, they assign special prosecutors to murder cases, and typically, the investigators are from robbery-homicide and one of the special units in the police department, whether it be the sheriffs or the LAPD that are investigating the case.

Given the district attorney's commitment to securing a conviction, it's crucial to have a top-tier criminal defense attorney on your side.

Otherwise, you're going to make it really easy for them. If they're charging someone with murder, they will do everything they can to make sure that person gets convicted.

Prosecution of Murder Cases

You have to realize that you're up against the best when it comes to a murder case. The prosecutor will do anything to get the conviction.

They're going to spend whatever money they need to be able to prove their case. I've handled many murder cases where they have different pieces of evidence against the client:

  • Sometimes, it's forensic evidence - DNA, fingerprints.
  • It's the identification of witness evidence where people see the person, and they're ready to testify that that person committed the murder.
  • Other times, they have video evidence.
  • They've got circumstantial evidence where they're proving a number of things, and if that's true, the person must have committed the murder. At least, that's how prosecutors will argue it.

Why You Need a Fighter

So, you have to have an attorney that has experience - that's been down the road you're about to travel. Don't get one of those attorneys that all they can do is do the preliminary hearing and then they decide to get off the case after that because they're afraid to go to trial.

It would be best if you had someone who is a fighter. Sometimes, these cases can be resolved, but in my experience in Los Angeles County, the district attorney does not negotiate murder cases.
